Why do I need to buy a liability policy when traveling to Mexico?

  • Because your U.S. policy won’t cover liability for any vehicle traveling into Mexico.
  • Since September 2014, Mexican authorities require all vehicles traveling on federal roads, bridges and airports to hold a liability coverage policy issued by a Mexican insurance carrier.
  • U.S., Canadian, or any foreign insurance policy is not considered "proof of financial liability" under the Mexican law.
  • In the event of an accident, some U.S. policies will cover damage on the insured vehicle (usually only within the first 25 miles South of the border), but NO FOREIGN COMPANY can legally cover third-party damages (liability).
  • Under Mexican law, most traffic accidents are considered a felony and authorities can retain both the driver and the vehicle until proof of liability is presented.

Auto Liability

Commercial Auto liability insurance is financial protection for a driver who, while operating a vehicle, harms someone else or their property. Automobile liability insurance only covers injuries or damages to third parties and their property, not to the driver or the driver's property.

• Freight Limits:--$750,000 - $5,000,000, depending on commodities transported; $300,000 for non-hazardous freight moved only in vehicles weighing under 10,001 lbs. 

Liability insurance includes two types of coverage:

  • Property Damage: This occurs when your commercial vehicle damages another vehicle, building, object, or other element of someone else’s property. Your liability coverage will pay for repairs or replacements of property damaged in an accident.
  • Bodily Injury: This is when someone gets hurt during an accident with your commercial vehicle. Liability insurance pays for anything to do with the injury. This might include hospital bills, medical expenses, or other expenses. The expenses depend on the type of injury and on you. 

Physical Damages

In Pro-Sol Insurance Agency, we strongly recommend to have Physical Damage Coverage in your Policy, this coverage will pay the costs of repairing or replacing your vehicle even if you’ve gotten into an accident with a driver who does not have insurance. Remember even the safest drivers can have an accident.

If you have a loan on your vehicle, or if you want to fully protect your vehicle, you should choose Physical Damage insurance.

Collision insurance will provide protection in case of a collision with another vehicle or any object.

Comprehensive insurance will provide protection in a theft or vandalism, fire, or anything caused by a natural disaster.

If your vehicle is leased, you probably are required to have Physical Damage Insurance. If your vehicle is fully paid for, Physical Damage coverage is optional.

When you select Physical Damage insurance, you also are required to submit a Stated Amount, which is your best estimate of the current value of your vehicle. The Stated Amount should take the age and condition of your trucks, as well as any permanently attached equipment or trailer. 

Motor Truck Cargo

Motor Truck Cargo insurance (Cargo) provides insurance on the freight or commodity hauled by a For-hire trucker. It covers your liability for cargo that is lost or damaged due to causes such as fire, collision, or striking of a load.

If your load is accidentally dumped on a roadway or waterway (Removal Expenses coverage), our coverage pays for the cost to remove debris or extract pollutants caused by the debris.

When you select Motor Truck Cargo insurance, you have to select a limit for your coverage. This limit determines the maximum amount your insurance co.  

Trailer Interchange

Is the coverage for when you have a Trailer Interchange agreement with another trucking entity. Trailer interchange does extend to liabilities an insured may incur for damages to a trailer while it is in his possession, and does not require that the trailer be attached at the time of loss. It also includes “containers” under the definition of trailers, so it is used most often for intermodal operations where the equipment includes both a trailer chassis and container.

These agreements exist in the trucking world to make shipping easier. efficiently. 

Non owned trailer

This will cover Non-owned trailers and containers attached to the covered vehicle with out a Trailer Interchange Agreement, it literally applies automatically. As if that wasn’t enough, this cover makes clear mention of maximum coverage amounts for physical damage on non-owned trailers. It is important to understand that the non-owned trailer must be attached to a covered power unit at time of loss for non-owned trailer physical damage to apply.

Commercial General Liability (CGL)

Commercial General Liability (CGL) is a type of policy that provides coverage to a business for bodily injury, personal injury, and property damage caused by the business’ operations, products, or injury that occurs on the business’ premises. Commercial General Liability is considered comprehensive business insurance, though it does not cover all risks a business may face.

Commercial general liability policies have different levels of coverage. A policy may include premises coverage, which protects the business from claims that occur at the business’ physical location during regular business operations. It may also include coverage for bodily injury and property damage that is the result of finished products. Excess liability coverage can be purchased in order to cover claims that exceed the limit of the CGL policy.
